The Problem with Pure GenAI Solutions

The website located at www.orcana.ai (the “Site”) is a copyrighted work belonging to Orcana, Inc. (“Orcana”, “Company”, “us”, “our”, or “we”). Certain features, applications, and services offered through the Site may be subject to additional terms, policies, or guidelines, which will be made available in connection with those features. All such additional terms are incorporated by reference into this Agreement.

Acceptance of Terms

These Terms of Use (“Agreement”) set forth the legally binding terms governing your access to and use of the Site. By accessing or using the Site, you agree to be bound by this Agreement (on behalf of yourself or the entity you represent) and represent and warrant that you have the authority and capacity to do so.

Subject to this Agreement, Orcana grants you a non-exclusive, non-transferable, revocable license to use the Site solely for personal or internal business purposes in connection with evaluating or using Orcana’s services.

Modify, make derivative works of, disassemble, reverse compile, or reverse engineer any portion of the Site;
Access the Site to build a competitive product or service;
Copy, reproduce, distribute, republish, download, display, post, or transmit any portion of the Site except as expressly permitted herein;
Use automated data scraping, crawling, or harvesting tools without our prior written consent;
Upload malicious code, interfere with networks or servers, or attempt unauthorized access to the Site or any related systems.

Any updates or new features provided by Orcana will be subject to this Agreement unless stated otherwise.

2.3 Ownership

All rights, titles, and interests in the Site—including all software, algorithms, models, and other intellectual property—are owned and reserved by Orcana, Inc. or its licensors. No ownership rights are transferred to you.

2.4 Feedback

You may provide ideas, feedback, or suggestions to improve Orcana’s products or services. You agree that Orcana shall own all rights to such feedback and may use it without restriction or compensation to you.

2.5 Modification and Availability

Orcana reserves the right to modify, suspend, or discontinue the Site, or any part thereof, at any time without notice or liability. Orcana may also restrict access to certain features or areas of the Site.

2.6 No Support

Unless otherwise agreed in writing, Orcana has no obligation to provide support, maintenance, or updates for the Site.

Communications Consent

By submitting your contact information, you agree that Orcana, Inc. (and its service providers) may contact you via phone, email, or text message (including through automated systems) regarding product updates, account notifications, or promotional offers. Standard message and data rates may apply.

You may opt out at any time by replying “STOP” to text messages or contacting legal@orcana.ai to update your preferences.

Your consent is not a condition of purchase.

Indemnification

You agree to indemnify and hold harmless Orcana, its officers, employees, contractors, and affiliates from any claims, damages, liabilities, losses, and expenses (including attorneys’ fees) arising out of:

(a) your use of the Site;
(b) your violation of this Agreement; or
(c) your violation of applicable laws or rights of third parties.

Orcana reserves the right to assume exclusive defense and control of any matter subject to indemnification, at your expense.

Disclaimers and Limitation of Liability

The Site is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

To the fullest extent permitted by law, Orcana’s total liability to you for any claim related to the Site shall not exceed the greater of:

(a) $100 USD, or
(b) the total amount paid by you (if any) to Orcana during the twelve (12) months preceding the claim.

Some jurisdictions do not allow limitations on implied warranties, so some of these limitations may not apply to you.

General Provisions

8.1 Changes to Terms

We may modify these Terms of Use at any time by posting an updated version on the Site. Continued use of the Site after changes take effect constitutes your acceptance.

8.2 Governing Law

This Agreement constitutes the entire agreement between you and Orcana concerning the Site and supersedes all prior or contemporaneous agreements or communications.
